FRANKFURT (mennonews.de) – Auf der heutigen Pressekonferenz in Frankfurt/Main stellte der US-Deserteur André Shepherd der deutschen Öffentlichkeit seinen Asylantrag vor. Er hatte den Antrag am Tag zuvor als erster US-Deserteur des Irakkrieges beim Bundesamt für Migration gestellt. Die Pressekonferenz wurde ausgerichtet von der in Bammental ansässigen Beratungsstelle für US-SoldatInnen, dem Military Counseling Network das zum Deutschen Mennonitischen Friedenskomitee gehört und dem Kriegsdienstverweigerungsnetzwerk Connection e.V.
André Shepherd war als Mechaniker für die Kampfhubschrauber Apache in Katterbach (Bayern) stationiert. Ein halbes Jahr lang wurde er 2004 und 2005 in der Nähe von Tikrit im Irak eingesetzt. Vor einer erneuten Verlegung im Jahre 2007 entschloss er sich, die Armee unerlaubt zu verlassen, da er sich bis dahin ausführlich über den Kriegseinsatz informiert hatte. “Als ich las und hörte, wie Menschen von den Maschinengewehren zerfetzt oder von den Hellfire-Raketen regelrecht in Stücke gerissen wurden, und erfuhr, wie Gebäude und Infrastruktur zerstört wurden, begann ich mich zu schämen für das, was ich da tat. Es war ein widerliches Gefühl, mir eingestehen zu müssen, dass ich im Grunde Tag für Tag am Abschlachten von stolzen Menschen beteiligt war.”
André Shepherd führte auf der heutigen Pressekonferenz seine Beweggründe für die Flucht aus der Armee und die Asylantragstellung aus. Er sieht den Krieg im Irak, wie den in Afghanistan, als illegal an. “Ich glaube, dass die Apache-Hubschrauber für einen bedeutenden Teil der getöteten Zivilisten im Irak verantwortlich sind, deren Zahl zuletzt auf 1,4 Millionen geschätzt wurde. Ich wusste, wenn ich noch einmal gehe, werde ich für den Tod und das Elend anderer verantwortlich sein. Ich musste mich entscheiden: entweder mein Gewissen verleugnen oder das Militär unerlaubt verlassen. Wenn ich einen erneuten Kriegseinsatz verweigere, droht mir eine Verfolgung wegen Desertion, Haft oder sogar die Todesstrafe. Dennoch war für mich der richtige Weg eindeutig: Ich musste raus aus der Armee.”
Er ergänzte, dass ein Antrag auf Kriegsdienstverweigerung für ihn nicht in Frage gekommen sei, da seine Überzeugung nicht den Regelungen des US-Militärs für Kriegsdienstverweigerer entsprächen. Sie verlangten, dass grundsätzlich jeder Krieg abgelehnt werde. Zudem habe er im April 2007 beobachten müssen, wie ein anderer US-Verweigerer, Agustín Aguayo, trotz seiner Gewissensentscheidung abgelehnt und zu acht Monaten Haft verurteilt worden sei.
Tim Huber vom Military Counseling Network betonte, dass der Asylantrag von Shepherd dazu aufruft, die Unterstützung Deutschlands für den von den USA geführten Krieg in Frage zu stellen. “Zwar hat sich damals die deutsche Bundesregierung gegen diesen Krieg ausgesprochen und deutsche Soldaten haben nicht direkt an diesem Krieg teilgenommen: Aber die USA nützt täglich den deutschen Luftraum für den Nachschub ins Kriegsgebiet. 60.000 US-Soldaten und Soldatinnen sind nach wie vor in Deutschland stationiert.”
Für Rudi Friedrich von Connection e.V. ist die Entscheidung von Shepherd “ein mutiger Schritt angesichts der drohenden Konsequenzen bei einer Ablehnung des Asylantrages.” Friedrich betonte, dass es bereits im Vorfeld der Antragstellung Unterstützung von anderen Organisationen gab. “Wir alle werden uns mit ganzer Vehemenz dafür einsetzen, dass André Shepherd den notwendigen Schutz erhält.”
Shepherds Rechtsanwalt, Dr. Reinhard Marx, erläuterte die Gründe, die für eine Asylanerkennung sprechen und verwies hier insbesondere darauf, dass “Shepherd mit seinem Dienst zur Wartung der Kampfhubschrauber Apache zu Recht annehmen muss, dass er damit völkerrechtswidrige Handlungen unterstütze.” Festzuhalten ist, dass der Antragsteller für seine Entscheidung, den weiteren Militärdienst im Irak zu verweigern, nachvollziehbare Gründe hat. Durch die Art und Weise der Durchführung von Operationen mit AH-64A Apache Kampfhubschraubern kommt es zur Begehung von Kriegsverbrechen. Eine drohende Bestrafung erfüllt somit die Kriterien der Qualifikationsrichtlinie der Europäischen Union und muss zum Flüchtlingsschutz führen.”

ich habe seinen vortrag gesehen…er hätte aus religiösen gründen verweigern können! und selbst wenn man auf der straße lebt, muss man mitbekommen was im irak passiert! das geht garnicht anders! zu zeiten von georg bush in die army einzutreten…das ist mehr als naiv!
