TESSIN, SCHWEIZ – (APD) Mit einem umstrittenen Entscheid zum Recht auf freie Kultusausübung von Studierenden jüdischen und adventistischen Glaubens hat der Tessiner Staatsrat am 30. Mai nach Ansicht der Leitung der Freikirche der Siebenten-Tags-Adventisten gegen das Grundrecht der religiösen Freiheit verstossen.
Der am Liceo di Lugano 2 studierende Tessiner Schüler C.B. , dessen religiöse Überzeugung als adventistischer Christ der Schulleitung bekannt war, wurde aufgeboten, die Maturitätsprüfungen an den sonst unterrichtsfreien Samstagen vom 2., 9. und 16. Juni abzulegen. Bekanntlich ist es Schülerinnen und Schülern strenggläubiger Juden und Adventisten aus Gewissensgründen nicht möglich an ihrem Ruhetag, dem Samstag (Sabbat), an Unterrichtsstunden oder Prüfungen teilzunehmen. Der Schüler hatte am 19. März die Direktion des Lyzeums gebeten, ihn von der Teilnahme an den Prüfungs-Samstagen zu dispensieren, und ihm mit einer individuellen Lösung für einen alternativen Nachprüfungstermin an einem anderen Wochentag behilflich zu sein. Die Direktion des Lyzeums hatte den Antrag am 30. März nicht nur abgelehnt, sondern ihn erneut zu den schriftlichen Maturaprüfungen an den drei Juni-Samstagen aufgefordert.
Am 11. April hat die Familie des Schülers einen Rekurs gegen den Entscheid des Luganeser Lyzeums 2 vom 30. März an das Departement für Erziehung, Kultur und Sport gerichtet. Der Departementsvorsteher, FDP-Regierungsrat Gabriele Gendotti, bestätigte mit Schreiben vom 7. Mai die ablehnende Haltung der Luganeser Schuldirektion. In ihrer Verzweiflung, ausgelöst durch den starken psychischen Druck auf den Schüler durch eine Nichtteilnahme an der Prüfung einen Schulzeitverlust zu erleiden, wandte sich die Familie mittels einem Tessiner Rechtsanwalt am 23. Mai – zehn Tage vor dem Prüfungstermin – in einem weiteren Rekurs an den Tessiner Staatsrat. Dieser hat nach Meinung des Anwalts mit “sehr umstrittenen Argumenten” das Rekursbegehren am 30. Mai endgültig und ohne Kostenfolge abgelehnt. Inzwischen wurde der Fall dem Bundesgericht in Lausanne zur Überprüfung vorgelegt.
Die Schuldispens für jüdische und adventistische Studierende an Schweizer Schuleinrichtungen hatte in den letzten Jahren keine Probleme aufgeworfen. Trotzdem hatte die Schweizer Hochschulkonferenz (EDK) im letzten Jahr vorsorglich die Konferenz schweizerischer Gymnasialrektorinnen und Gymnasialrektoren KSGG) noch einmal darauf hingewiesen, dass “die Gymnasien auf religiöse Feiertage im Allgemeinen und auf den Sabbat im Besonderen grundsätzlich Rücksicht nehmen und deshalb Prüfungen oder anderweitige obligatorische Veranstaltungen an solchen Tagen die Ausnahme bilden sollten.” Die EDK hatte die Mitglieder der KSGG gebeten, auf religiöse Feiertage Rücksicht zu nehmen bzw. für individuelle Lösungen bei der Festlegung von Prüfungsterminen offen zu sein.
